If your car just failed a smog test in San Jose, you can still donate it. A failed emissions or smog test does NOT disqualify your vehicle from donation. Through Bay Wheels, Heritage for the Blind accepts cars, trucks, and SUVs in almost any condition—including vehicles that can’t pass California smog. Whether you’re in Willow Glen, Alum Rock, Evergreen, or out near Blossom Valley, we’ll help you turn that problem car into help for people who are blind or visually impaired.
Here’s how it really works in California: you do NOT need to fix the car or get it to pass smog to donate. A charitable donation is a title transfer to a nonprofit, not a private sale, so the normal smog certification rules that apply when selling a car to another person typically do not apply. Bay Wheels arranges to have your vehicle sold as-is at auction or to a buyer who understands it failed smog and plans to repair it. You avoid repair bills and Craigslist headaches, the charity receives funds, and you receive a tax receipt. Pickup is free anywhere in the San Francisco Bay Area—Downtown San Jose, North San Jose tech campuses, Berryessa, Cambrian Park, and more.
How to get your free pickup scheduled
1. Confirm your failed-smog car is eligible
If your vehicle failed a smog or emissions test in San Jose, it is still eligible for donation through Bay Wheels. We accept most cars, running or not, including those with check-engine lights, unresolved smog issues, or expired tags. You don’t have to spend money chasing repairs just to donate—tell us the condition honestly and we’ll take it from there.
2. Call or submit the quick online form
From your home in Willow Glen, East San Jose, or near Santana Row, contact Bay Wheels with your car’s basic info: year, make, model, general condition, and where it’s parked. Let us know it failed smog so we can prepare the tow. We’ll answer your questions about title, registration, and how the failed emissions test affects (or doesn’t affect) your donation.
3. Schedule free pickup anywhere in San Jose
Bay Wheels arranges a licensed tow company to pick up your car at no cost to you—whether it’s in your driveway in Evergreen, at an apartment in North San Jose, or in a shop lot after the failed test. You don’t need a current smog certificate. Just be available to release the vehicle and sign the title so we can complete the donation transfer.
4. Sign the title and transfer ownership
On pickup day, you sign over the title directly to Heritage for the Blind’s vehicle program via Bay Wheels. Because this is a charitable donation and not a private sale, the usual California requirement to provide a passing smog certificate to a buyer typically does not apply. Once you sign, liability and future smog responsibilities are transferred with the vehicle.
5. We sell the vehicle as-is and handle smog
After pickup, Bay Wheels arranges for your failed-smog car to be sold as-is at auction or to a buyer who repairs vehicles. They take on the emissions and repair work, not you. Proceeds support Heritage for the Blind’s programs for blind and visually impaired people, without you ever having to pay for diagnostics, parts, or retests.
6. Receive your tax receipt for your donation
Once the vehicle is sold, you’ll receive a tax receipt you can use for your federal income tax deduction. In many cases this is at least $500; if the sale amount is over $500, you’ll get IRS Form 1098-C from Heritage for the Blind. Keep this with your records and share it with your tax professional at filing time.
Potential complications to watch for
Missing or incorrect title can delay pickup
Tip: Even though your car failed smog, we still need to transfer ownership properly. If you’ve lost your California title, request a duplicate from the DMV before scheduling pickup when possible. Having the correct name and VIN on the title makes the donation and liability transfer smooth and prevents headaches later.
Cars blocked in shops or garages after smog tests
Tip: If your vehicle is at a smog station or repair shop in San Jose, let us know when you contact Bay Wheels. We’ll coordinate with the shop for towing access and timing. You may need to sign a release with the shop, but you do not need to approve or pay for any repairs to move forward with your donation.
Out-of-date registration or long-term non-op status
Tip: Expired tags or non-op status typically do not stop you from donating. However, past due registration fees are tied to the vehicle. Bay Wheels and the buyers understand this. Be transparent about the registration status so we can set expectations and properly note it in the transfer and auction paperwork.
Assuming you must repair it before donating
Tip: Many San Jose owners think they must fix a failed-smog issue before donating. That’s not required. Because this is a charitable transfer, smog rules for private sales usually don’t apply. Avoid pouring money into repairs just to give the car away—donate it as-is and let the charity’s buyers handle the emissions work.
